What To Do If.........
What if my manager says s/he wants to meet with me? If you are approached by your manager for a meeting, ask what the subject is. If the subject is about you or your performance, then ask if there is any chance that you may be disciplined as an outcome of the meeting. If the answer is "yes", or if you believe that the meeting may result in discipline, as a union-represented nurse you have the right to request union representation. If you are denied that opportunity, you may refuse to attend the meeting.
What if my manager says the meeting isn't disciplinary and then, during the meeting, s/he starts to ask me questions about my performance or behavior? As soon as you are asked questions about your performance or behavior, you are providing information that may be used for disciplinary purposes. Question-asking triggers your right to union representation, so you should stop the meeting and tell your manager you are requesting to postpone the meeting until you can arrange for representation.
How do I arrange for union representation? Tell your manager that you will immediately call the AURN Hotline (494-6880) to request representation. The Hotline is staffed by AURN nurses trained to represent you. A member of the Grievance Committee will return your call within 24 hours. At that point, the representative will arrange a convenient time to meet with you and your manager.
Do I have the right to union representation for any meeting with my manager, such as evaluations and counseling sessions? No. The law gives you the right to representation (called Weingarten Rights) only when you are being asked questions about your performance or behavior that could lead to discipline. If your manager is just going to talk TO you -- and not ask you questions -- then the representation rights don't apply.
What if I'm presented with a letter of reprimand or other disciplinary action? If you disagree with the discipline, call the Hotline (494-6880) immediately to discuss whether you should file a grievance (you have between 10 and 30 days to file, depending on the circumstance). In any case, you should always write a rebuttal to the content of the discipline, so that your file will contain your side of the story.
What do I do if I am sent home by my manager? Being sent home on administrative (paid) leave means that management wishes to investigate a relatively serious charge against you, sometimes related to the OHSU Code of Conduct. The level of the charge will determine whether you can stay in the workplace or remain home until the investigation is finished. If you are told to go home, ask your manager for the reason. S/he will generally not discuss the specifics but can give you the general reason. In any case, call the AURN Hotline (494-6880) when you arrive home, to arrange a discussion with an AURN Grievance Committee member. S/he will speak with your manager to set up arrangements for your investigatory meeting.
What if I'm involved in a drug- or alcohol-related investigation? If you are believed to be impaired while on duty, your manager will accompany you to an outside lab for a UA. Then s/he will drive you home and arrange for an investigatory meeting. A nurse member of the Drug Free Taskforce will be called to attend the meeting with you and will also arrange for a member of the Grievance Committee to attend.
